Lawyers of Jin Mao Law Firm Invited as Expert Team to Provide Support for the Translation of the Chinese Reference Version of the SHAC ICSID Series Documents
2025年新修订的《仲裁法》已于2026年3月1日起正式施行，其中第94条规定：
The 2025 newly revised Arbitration Law has came into force on March 1, 2026. Article 94 thereof stipulates:
“仲裁机构、仲裁庭可以依照有关国际投资条约、协定关于将投资争端提交仲裁的规定，按照争议双方约定的仲裁规则办理国际投资仲裁案件。”
"Arbitration institutions and arbitral tribunals may handle international investment arbitration cases in accordance with the provisions of relevant international investment treaties and agreements on submitting investment disputes to arbitration, and pursuant to the arbitration rules agreed upon by both parties to the dispute."
为加强对国际投资仲裁规则的理解与适用，并适配上海仲裁委员会仲裁规则（第二条第三款），经上海仲裁委员会与世界银行国际投资争端解决中心（ICSID）联络沟通并征得其许可，上海仲裁委员会组织专家团队对ICSID有关规则文件进行中文翻译，形成相应中文参考译本。
To enhance the understanding and application of international investment arbitration rules and to align with Article 2, Paragraph 3 of the Arbitration Rules of the Shanghai Arbitration Commission (SHAC), after liaising with and obtaining permission from the International Centre for Settlement of Investment Disputes (ICSID) of the World Bank, organized expert teams to translate relevant ICSID rules and documents into Chinese, resulting in corresponding Chinese reference versions.
本所合伙人韩正律师、李奕轩实习律师受邀为其中的《ICSID附加便利规则和条例》提供了中文译本。《ICSID附加便利规则和条例》授权ICSID秘书处管理国家与他国国民之间不属于《华盛顿公约》适用范围的程序。该套文件包括《ICSID附加便利规则》《ICSID附加便利行政和财务条例》《ICSID附加便利调解规则》《ICSID附加便利仲裁规则》等文件。
Partner Mr. Han Zheng and trainee lawyer Mr. Li Yixuan of our firm were invited to provide the Chinese translation of the ICSID Additional Facility Rules and Regulations. This document authorizes the ICSID Secretariat to administer proceedings between a State and nationals of another State that fall outside the scope of application of the Convention on the Settlement of Investment Disputes between States and Nationals of Other States (the Washington Convention). The set of documents includes the ICSID Additional Facility Rules, ICSID Additional Facility Administrative and Financial Regulations, ICSID Additional Facility Conciliation Rules, ICSID Additional Facility Arbitration Rules, and other related documents.
